File Under: Jurisprudence & Litigation, Political Parties

Florida Today reports a story that would be comical if it weren't so sad. It seems that the Florida Department of State's Division of Elections has issued an advisory opinion that says issue-oriented polling is illegal in the state.

According to Assistant General Counsel Gary Holland, the fact that the state's polling law only mentions candidate polls and omits issue polls means that issue-oriented polls are not allowed.

Here is the text of the law:

"Any candidate, political committee, committee of continuous existence, electioneering communication organization, or state or county executive committee of a political party may authorize or conduct a political poll, survey, index, or measurement of any kind relating to candidacy for public office so long as the candidate, political committee, committee of continuous existence, electioneering communication organization, or political party maintains complete jurisdiction over the poll in all its aspects."

No word yet on whether Florida residents are still allowed to talk about current events with their neighbors.
