The federal lawsuit filed in August against the town of Manlius’ sign law has been dropped now that the town board has repealed its restrictive law.
Manlius resident David Rubin, who is the former dean of Syracuse University’s communications school, said the lawsuit isn’t proceeding because the town’s sign law doesn’t exist anymore.
Rubin said the lawsuit was “dismissed without prejudice” which refers to the absence of a decision on the merits of the case, leaving the parties free to litigate the matter in a subsequent action.
Rubin said he plans to be vigilant in reviewing the new rules the town formulates.
“This is a victory for the First Amendment,” he said.
